OF THE CODE ENFORCEMENT BOARD
OF THE CITY OF MARY ESTHER, FLORIDA
June 21, 2004
The Code Enforcement Board (CEB) held a meeting on Monday, June
21, 2004 at 5:30 PM at the Mary Esther Council Chambers, Mary Esther,
Florida.
CALL TO ORDER
The meeting was called to order by Mr. Phil Keesee, at 5:33 PM
ROLL CALL
Present: Mr. Phillip Keesee, Mr. Bill Zuppa, Mrs. Rachel Fay, Mr.
Steve Weimers
Absent: Mrs. Jill Crew
ALSO ATTENDING: Mr. William Bradley, Code Compliance Officer, Mrs.
Shannon Smith, Secretary

APPROVAL OF MINUTES:
Minutes Tabled until the next meeting.
UNFINISHED BUSINESS:
Mrs. Fay brought up the issue of the city possibly being able to
collect an extra fine when an individual is ticketed by the Sheriff’s
Department for playing loud music. Mr. Keesee thought this might
be an issue that Mrs. Fay would be able to pursue better on a personal
level than as the Code Enforcement Board. Issue tabled until Mr.
Bradley can check on the legalities with the attorney. Mrs. Fay
said that she thought the City Council might have to get involved
with this issue and pass a resolution or law before the Code Enforcement
Board could enforce it and all members agree.
NEW BUSINESS:
Mr. Bradley stated that according to the Rules & Regulations
of the CEB, the Board is supposed to elect officers annually in
June but suggests that the Board adopt a new rule of electing officers
every two years in June and that according to Florida Statutes and
the attorney, it is O.K. to do this.
Mr. Zuppa motioned to change the Rules & Regulations of the
CEB to elect officers every 2 years in June.
Motion 2nd by Mr. Keesee
Motion passed unanimously
Mr. Bradley pointed out that Mr. Zuppa’s term of office should
have ended in April 2004.
Mrs. Fay motioned to extend Mr. Zuppas’ term for one more
year.

Motion passed unanimously
Members discussed the procedure when a member takes the place of
another in the middle of that person’s term and agree that
the policy is to finish the existing term and carry out one complete
full term.
Mr. Bradley introduced Shannon Smith as the new CEB Secretary.
Mr. Bradley announced there will be a formal meeting on July 19th,
2004 at 5:30 P.M. and suggested to the board to look over the Code
Rules and definitions that pertain to the City of Mary Esther.
OLD BUSINESS:
Mr. Keesee requests that the CEB Members all receive a new and
updated handbook with information that they need included in it.
Mr. Weimers asked if a member was allowed to abstain from voting
if there might be a conflict of interest during a hearing and was
told yes. Mr. Keesee suggested that before the hearing begins that
the question is asked if any board members would like to excuse
themselves from voting.
Mr. Zuppa brought up the issue of political signs and other signs
on the right away and in yards and asked what the rules were regarding
them. Mr. Bradley stated that there is no rule prohibiting the political
signs from being in yards; however, a sign may not be placed on
right-of-ways in accordance with Florida Statutes.
